This is a vacation rental. The rights and obligations of the parties to this agreement include unique provisions permitting the disbursement of rent prior to tenancy and expedited eviction of the tenants. Your signature on the attached booking form, or payment of money or taking possession of the property after receipt of this agreement, is evidence of your acceptance of this agreement and your intent to use this property for vacation rental only.
1.Formation of contract
Having obtained confirmation that the property is available for the dates required, you, the Tenant, must scan and email a completed and signed booking form (2 pages attached) and thereafter, a deposit of 25% of the property rental within 5 days of receipt of confirmation of availability. A binding contract between the person who has signed the booking form (The Tenant) and the owners of Caicos Blue Hiideaway will be made when we issue a confirmation. You are responsible for payment of the price of the vacation and the compliance of members of your party with these conditions and we reserve the right to refuse a booking without giving any reason.
2.Payment
The balance must be paid not later than 60 days before arrival. Failure to pay the balance on time will constitute cancellation and cancellation charges will become payable in accordance with paragraph 5. If you book a vacation less than 60 days before arrival, the full rental fee is payable at the time of booking unless otherwise stated.
3.The Price
Prices are in US dollars and the rental period is weekly, pro-rata if longer, unless otherwise stated. The property is let fully furnished and equipped. Premises are to be used solely as a private dwelling for the occupancy of tenant and tenant's family/friends.
Special Note Regarding Accommodation Tax
The Turks & Caicos Government introduced an 11% accommodation tax on all private villa rentals effective 1st June 2004. In order to comply with Government regulations we must collect this tax at the time your final balance is due.
4. Alterations or cancellation by owner
In the unlikely event that it is necessary to make an alteration to or cancel the holiday accommodation specified in the booking form we will inform you as soon as possible and, if requested, we will try to arrange alternative holiday accommodation of a similar type and standard and in a similar location as that originally requested. If the alternative holiday accommodation is not acceptable, we will refund in full all monies paid, or as an alternative allow you to rebook the original property for another period. In either event we shall be under no other liability.
5.Cancellation by Tenant
Any cancellation by you (for whatever reason) must be in writing and addressed to us (fax or email is acceptable). The effective date of cancellation is when written notification is received by us.
If you cancel your booking or we cancel due to non payment we shall be entitled to the following percentage of the holiday cost:
More than 60 days before arrival: 25% of the rental fee
Less than 60 days before arrival: 100% of the rental fee
Note: If we are able to re-book the property for the period in question, we will provide a refund of the deposit of full fee if applicable, less $200 administration and less any discount required to re-secure a booking and, the total gross rental agent fees if a new booking is gained through a commission-charging agency.
6. Amendments by The Tenant
Upon receipt of your booking confirmation, please check the details to make sure they are correct. If after you're booking has been accepted you require us to amend it in any way, you must notify us in writing as soon as possible. We reserve the right to treat a change of property and/or holiday dates as a cancellation of one holiday and the booking of another.
7. Information
While we make every effort to ensure that descriptions supplied are accurate, you must accept that minor differences between the photograph, illustration and/or text used and the actual property may arise. We reserve the right to make modifications to the property specification that are considered necessary in the light of operating requirements. In the interests of continued improvement, property owners reserve the right to alter furniture, fittings, and amenities, facilities, either advertised or previously available, without prior notice. If significant material changes occur after your booking has been confirmed we will advise you if there is time before departure.
8.Occupancy Restrictions
Premises are to be used solely as a private dwelling for the occupancy of the Tenant and Tenant's family/friends. During the term of this lease the Tenant is responsible for the property and action of his/her guests. Leaseholder must be at least 25 years of age. Occupancy shall not exceed 8 people at any time without prior written permission of owner. Possession by fraud or misrepresentation or material breach of the terms of the vacations rental agreement results in termination of this tenancy. Breach of this lease agreement is grounds for expedited eviction without refund.
9.Smoking
This property is a NON-SMOKING property. Smoking of any kind is not permitted inside the house. If smoking outside the house please ensure that smoking material are discarded carefully in the trash and not on the ground anywhere on the property.
10. Access
The property owner or his/her representative shall be allowed access to the holiday accommodation at any reasonable time during any holiday occupancy for the purposes of inspection and maintenance.
11. Arrival and departure
You can check into the property at any time after 3pm on your arrival date, and the accommodation must he vacated by 10.00 a.m. on the last day. In some cases it may be possible to check in earlier than 3pm, or check out after 10am but this depends entirely on other bookings that may have been made on the property and is subject to confirmation by Caicos Blue Villa owners or managers.
12. The Tenant's responsibilities
You must keep the holiday accommodation and all furniture, fittings and effects in the same state of repair and condition as at the commencement of the holiday, and leave the holiday accommodation in the same state of cleanliness and general order in which it was found. You are responsible for all damage or loss which occurs to the property or its contents during your occupation (with the exception of normal wear and tear. You must advise us of any damage caused as soon as it occurs. If damage is found after check out, and has not been advised of to the owners or their representatives, the full repair/replacement charges will be levied, without exceptions.
You are responsible for for air conditioning usage over and above the allocated allowance included in the rate for the property of $150.
Upon arrival, you will be asked to provide authority to charge your credit card with any and all charges for loss, damage, telephone usage and air conditioning. Documentary evidence of such charges will be provided.
Please note this is a non smoking house. No smoking is allowed within the premises.
13. Complaints
In the unlikely event that you are disappointed with the holiday accommodation, you must contact either the property managers or ourselves as soon as possible and we will try to solve the problem. If after that you still feel that the problem has not been resolved to your reasonable satisfaction you should within 7 days of returning from holiday, put your comments in writing to us.
14. Waiver of Liability
The Tenant will assume all responsibility for Tenant and Tenants guests for the risk of using the property and agree to waive any claim whatsoever against the Owner and/or Owners representatives for all costs and expenses, for accidents or claims arising from the use of the property. We the owners, shall not be responsible for death or neither personal injury of any holidaymaker, nor loss of, theft of or damage to any personal possessions. We shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control including though not limited to act of God, explosion, flood, tempest, pests, fire or accident, war or threat of war, act of terrorism, civil disturbance, acts, measures of any kind on the part of any governmental or local authority, or adverse weather conditions including hurricane or tropical storm. In the event of cancellation by either party the cancellation and refund conditions as detailed in clauses 4 and 5 of this document shall apply. We cannot be held responsible for breakdown of mechanical equipment such as pumps, boilers etc., nor for failure of public utilities such as water and electricity. We are not responsible for noise or disturbance originating beyond the boundaries of the holiday accommodation or which is beyond our control.
In respect to access to the Caicos Blue Hideaway swimming pool the Tenant acknowledges that no life guard is provided and therefore accepts full responsibility for their own safety should they wish to engage in the use of said pool, since it is an inherently dangerous activity. The Tenant also acknowledges that they are responsible for the supervision of children, particularly as regards the use of the swimming pool. The Tenant understands that the swimming pool is on the edge of a hill and standing or walking on the sides of the pool poses a threat and is dangerous for themselves and or any children and is explicitly requested not to do so nor allow any of the tenants guests to do so.
13. Law
All contractual obligations arising out of these booking conditions shall be governed by the laws of the Turks and Caicos Islands.
14. Consumer Data Privacy
We only hold enough data to maintain contact, including email address, telephone numbers and where required an address. We do not sell or give acces to any third party other than to secure payments.
